Proxy Servers are known targets for abuse so we operate enforce Terms of Service to maintain the integrity of our Proxy Servers for all of our customers.
Violation of any of these Policies may lead to immediate termination of your account without compensation, and we reserve the right to pursue damages if applicable.
Prohibited Uses & Acceptable Usage
You undertake to abide by our Acceptable Use Policy and specifically note we do not allow accessing any kind of pornography (even legal), or access to online gambling sites. Violation of our AUP terms may lead to the termination of your account without compensation.
Acceptance of Orders
Your order is not deemed to have been accepted, and no contract or agreement or obligation exists upon us, until we have explicitly accepted your order. Pre-payment by the customer does not obligate us to accept the order. If we do not accept the order, we will refund your fees within 1 business day. We may reject your order for any reason and are not obligated to disclose a reason.
Activation of Orders
New orders received during non-holiday weekdays Monday to Thursday are usually set up within one business day. During UK and US East Coast working hours, set up time is typically a few hours. Orders received on a Friday or weekend may not get set up until the next business day, although it may be faster. If we expect it to take longer than this, we will email you within 1 business day with an updated estimate for account activation. Occasionally the Sales and Billing departments have a company wide holiday, in which case order setup could be delayed. In such an instance, there will be full details on the automated email you'll receive when you order.
Orders from new customers may take a little longer to set up while we verify your order - if this is the case, we will advise you by email within 1 business day.
One time purchases auto-cancel at the end of the subscription period and you will not be charged again.
All services are auto-renewing unless otherwise stated or agreed. Approximately 3 days before the end of the billing cycle, you will be emailed an invoice for the next billing cycle. If we do not hear from you otherwise, the service will then auto-renew the day after your current billing cycle ends.
If you have an automated payment method set up, that will be used to automatically settle the invoice and you will be emailed a receipt.
If you do not have an automated payment method set up, you are responsible for ensuring the invoice is manually paid on or before the due date. Although most services are auto-renewing, it is not guaranteed that your payment method is auto-paying. We will remind you of that after sign-up.
Invoices that are not paid on time may lead to service suspension or termination.
You may cancel your service without penalty within the first 7 days from ordering and receive a 100% refund for all services except "metered" services like the Big-G Stealth Extractor and the Proxy Server Cloud services. For metered services, you would receive a pro-rata refund for unused credit only. If you have used up or exceeded your month's allocation within those first 7 days, then there will be no refund at all. When refunds are due, we will make them within 2 business days of confirmation that a refund is due.
Thereafter, you may cancel at any time without penalty up to one business day prior to the renewal date.
When you cancel a service, it means that you do not want it to renew at the end of the billing cycle, but your service will continue to the end of the current billing cycle. No pro-rata refunds are made for service cancelled part way through the billing cycle.
We may cancel your service at any time without notice. If we cancel it part way through a billing cycle, we will provide a pro-rata refund for the unused portion.
Different plans have different limits, usually dictated by the type of Proxy Server and its designated use which are monitored and enforced. If you exceed them, your service may be immediately terminated without compensation if we believe you are abusing the system, otherwise we will warn you first.
This is typically only an issue with Video Streaming. If you intend to video stream, you should use a service that is designed for streaming and has higher bandwidth limits.
Bandwidth limits for non-streaming services are designed to be high enough so that regular usage for the designated purposes will never get even close to being exceeded. We're not trying to trick you, rather just preventing abuse, and to ensure we can continue to supply a stable and reliable service to all our other customers.
Search Engine Ranking Software Modes
It is an express condition of use, that any software that runs any automated queries to Search Engines is always run in “Be Nice to Search Engines” or “Human Emulation” mode. This means queries are sent no more frequently than every 20 seconds, or if your software supports it, it may be random intervals of every 15 to 20 seconds. This applies to all of our Proxy Servers and VPN's, regardless of which you buy, except for the Big-G Stealth Extractor and Proxy Server Cloud services, which have their own limits, described on their Product Pages.
Some Proxy Servers explicitly state in their descriptions that they are not to be used with Search Engine software, in which case you may not do so, and if you do, it is a violation of these terms, and we will terminate your account immediately without compensation.
If a Proxy Server or VPN Service on a non-Dedicated service should become blocked/blacklisted for any reason, we may replace it at our discretion but are not obligated to do so. This is regardless of whether the fault was of the customer, or other customers on the shared service. We are likely to make replacements on the odd occasion as a courtesy, or where it can be shown that the service is not usable at all, but this is not an obligation, and each case will be individually discussed with the customer.
For customers running Search Engine reports on non-Dedicated Plans, ie Virtual Dedicated Plans, occasional temporary bans are an implied risk, and we would not automatically make replacements. Instead you would be expected to wait a few hours for the ban to clear. Only if it can be shown that the ban is permanent - and through no fault of your own, would we be obligated to make replacements. To avoid these risks, customers can upgrade (or order in the first place) Dedicated Plans.
For Dedicated services, there should not be any bans caused by other customers. If there are bans, we will replace them in the event of the occasional "accident" at our discretion, or if it can be shown it is not the fault of the customer. The onus is on the customer to use the services responsibly to ensure they are not blacklisted.
For all Parallel and Geo Proxy Server accounts that can be used for SEO reporting/ranking use, as indicated in the product description, customers may subscribe to "Dedicated" Plans. Among other benefits, we undertake to guarantee each Proxy Server's IP address in your plan is used by only for SEO SEO reporting/ranking usage.
We do not accept any liability for damages from your usage of our services, nor do we accept any liability for damages due to any omission or errors in running the services. Our maximum liability in any circumstances from the failure of any of our services or errors, is at most the pro-rata unused part of any pre-payments of fees.
This agreement shall be governed by the laws of England. If any one part of this agreement shall be found to be unenforceable, the rest of the agreement shall still stay in force.
